NLRB Postpones Date for Displaying Mandatory Poster

The National Labor Relations Board has extended the effective posting date of the mandatory employee rights notice at the request of a federal judge in Washington, DC, whose court is hearing a legal challenge to the posting requirement. The NLRB states that postponing the effective date will facilitate the resolution of the legal challenges that have been filed. This is the second extension; the new date is April 30, 2012.

The notice must be posted in the same place that other workplace notices, such as EEOC posters, are “customarily” posted. In addition, employers who post personnel rules and policies on the internet or company intranet are required to post the NLRA notice in a like fashion. Failure to post the notice will be treated as an unfair labor practice.
