Suit to Strike Down Arizona Medical Marijuana Law Dismissed

On January 5, a Maricopa County Superior Court judge dismissed a lawsuit filed by Arizona Governor Jan Brewer challenging Arizona’s Medical Marijuana Act. Brewer filed the suit out of concern that state employees carrying out the new law would be exposed to prosecution by federal authorities. The judge threw out the suit based on her finding that there was no genuine threat of federal authorities taking action against state employees even though marijuana remains an illegal substance under federal law.

Arizona’s Department of Health Services suspended portions of the new law dealing with dispensaries pending the outcome of this lawsuit.  Supporters of the law hope that the state will now begin accepting applications for dispensary licenses.
