The forms used by most employers to comply with the Family and Medical Leave Act have been renewed until February 28, 2015. There were no substantive changes to the forms other than the expiration date.
As anticipated, the Dept. of Labor did not add language reflecting the safe harbor from genetic discrimination claims now available to employers under the Genetic Information Nondiscrimination Act. We recommend that employers add this language to the WH-380-E – Certification of Health Care Provider for Employee’s Serious Health Condition.
