Use Expired I-9 Form Until Further Notice

If you are tasked with completing the employment eligibility verification process at your organization, you have probably noticed that the I-9 form’s expiration date (08/31/2012) has passed. U.S. Citizenship and Immigration Services (USCIS) has announced that employers should continue using the expired edition of the form until it releases a new version.

Employers must verify the identity and work eligibility of all new hires by completing and retaining the I-9 form. The requirement has been in place since late 1986. 

USCIS is in the process of revamping the I-9 form. As part of that process, USCIS has twice requested comments from employers about how the new I-9 form should look. The proposed new form is widely viewed as an improvement and is designed to reduce preparer error.
