Q & A – Is there an update on the timing of the Notice of Marketplace (Exchange) required to be issued by employers under Health Care Reform?

Q. Is there an update on the timing of the Notice of Marketplace (Exchange) required to be issued by employers under Health Care Reform?

A. Under the Patient Protection and Affordable Care Act (PPACA), employers are required to provide to each employee a written notice informing the employee about the existence of Marketplaces (Exchanges) and the employer’s cost sharing plans.

The original deadline for providing the Notice was March 1, 2013.  However, the Department of Labor (DOL) delayed the deadline.

The DOL has not yet issued a new deadline but expects the timing for distribution of the Notice to be late summer or fall of 2013.  This timing will coordinate with the open enrollment period for the Marketplaces.

Once the timing of the Notice is determined by the DOL, the date will be posted on MSECs Health Care Reform Learning Zone, along with any updated Notice requirements.
