Q. Who is covered by wage and hour law?

 

A. The federal Fair Labor Standards Act applies to virtually all employers in the United States.

 

Very simply, if an employer has goods or services traveling within or connected to interstate commerce, or if the employer has two or more employees, the employer is covered by the FLSA.

 

There is an important distinction between employees who are not covered by the act and employees who are exempt from some of the act’s provisions. Employees who are not covered are outside the authority of the FLSA, and no portion of the act applies to them.​
