On Tuesday, Vice President Biden announced that the highly anticipated new affirmative action regulations for the disabled and veterans were approved. Some of the highlights from the veterans regulations include requiring contractors to establish an annual hiring benchmark, either based on the national percentage of veterans in the workforce (currently 8 percent), or based on the best available data and factors unique to their establishments. The disabled regulations include the establishment of a 7 percent hiring goal. Both regulations include additional recordkeeping requirements. The regulations will soon be published in the Federal Register, and contractors will have 180 days from that date to implement and comply with them.
Earlier in the week, the Office of Federal Contract Compliance Programs (OFCCP) released the revised Federal Contract Compliance Manual (FCCM). The FCCM provides the procedural framework for executing compliance reviews. The FCCM offers contractors valuable guidance on how to comply with affirmative action laws and what to expect during a compliance review.
