Q & A – What do I do if the applicant or employee refuses to be tested?

Q: What do I do if the applicant or employee refuses to be tested?

A: Employer policies should address this possibility.  Under most policies, refusal to be tested is treated the same as a positive test result and often results in termination.  Employers should assure that the testing requirement was clearly communicated before insisting on the test and hear the employee’s objection before taking action.
