Q & A – What do I do if the applicant or employee refuses to be drug tested?

Q: What do I do if the applicant or employee refuses to be drug tested?

A: Employer policies should address this possibility. Attorneys at Employers Council can review drug testing policies and provide suggestions and recommendations. Under most policies, refusal to be drug tested is treated the same as a positive test result and often results in termination.  Employers should assure that the testing requirement was clearly communicated before insisting on the test and hear the employee’s objection before taking action.
