A: An employment agreement requires two parties with the capacity to form an agreement and an offer, acceptance, and consideration.  Consideration is something of value that is given in exchange for the agreement.  Where the agreement is presented at hire, employment can be the consideration.  But employers presenting agreements to current employees should provide additional consideration.  Depending upon the state, continued employment may not be adequate consideration.
