Q & A – What if I learn that the complaining employee engages in the same conduct that he or she is complaining about?

Q. What if I learn that the complaining employee engages in the same conduct that he or she is complaining about?

A. The complaining employee’s actions do not “invalidate” his or her complaint. The employer should still investigate. If the conduct is inappropriate or potentially unlawful, it needs to be addressed with all employees engaging in the conduct, including the complaining employee.
