Transgender Guidance Available from OSHA

The Occupational Safety and Health Administration has released guidance to assist employers in navigating the issue of providing appropriate restroom access to transgender workers. In addition to other practical information, it includes a link to a model employer policy. Although the guide details best practices, the agency emphasized in a disclaimer that the Guide to Restroom Access for Transgender Workers “is not a standard or regulation, and it creates no new legal obligations.”

The Colorado Anti-Discrimination Act was amended effective August 3, 2007, to prohibit discrimination in employment because of sexual orientation, which the law defines to include transgender status.
