White-Collar Exemption Rule Coming in July

Last week, U.S. Department of Labor (DOL) Solicitor of Labor M. Patricia Smith gave July 2016 as the firm date for the DOL’s Final Rule on the Fair Labor Standards Act white-collar exemption regulations. She stated the Final Rule would take effect 60 days after publication.

The DOL issued proposed amendments to the white-collar exemption regulations last July. Significantly, the DOL proposed increasing the minimum annual salary for employees exempted from minimum wage and overtime under the Executive, Administrative, and Professional exemptions from $23,660 to $50,440.

Earlier this month, more than 100 members of the U.S. House of Representatives signed a letter to Secretary of Labor Thomas E. Perez expressing serious concern with the proposed changes.
