Q. When are employees eligible for FMLA?
A. Employees are eligible for leave if they: 1) have worked for the employers for 12 months (this time need not be consecutive); 2) have actually worked 1,250 hours in the 12 months preceding the need for leave (paid time off is not included); and 3) work at a worksite with at least 50 employees within 75 miles. Some employers may choose to waive the third requirement and extend FMLA eligibility to employees working at small, remote locations.
