As of August 10, 2016, Colorado employers will no longer be required to complete a Colorado Affirmation Form for new hires. Gov. John Hickenlooper signed House Bill 16-1114 repealing this requirement earlier in June.
Between now and August 10, 2016, employers will continue to complete the Colorado Affirmation Form and attach I-9 document(s) to the form for all new hires. The bill is silent on what employers should do with Colorado Affirmation Forms that were completed for all current employees hired after January 1, 2007. Given that the bill did not specify the treatment of these completed forms, employers should continue to retain them through the duration of the employees’ employment. Once the employee departs, the form can be destroyed.
