Q. What should I do if a law enforcement official requests to view a personnel file?

A. The designated person that handles HR matters should be contacted immediately. The designated person should confirm that the person and credentials are official (check identification badge and call the organization to validate). If a subpoena or court order is not presented the employer is not required to provide information. It may be appropriate to provide the information per the company policy such as employment dates, title, position, or salary. But if the request goes beyond what is stated in the policy, the request may be denied. Contact your MSEC representative for more information.
