A. This is not recommended. The Equal Employment Opportunity Commission has said that “blanket” prohibitions like these may result in adverse impact discrimination against minorities. Instead, the EEOC recommends that employers screen applicants based on convictions that are job-related. This may mean that screening is different across the organization for different kinds of jobs. A job-related connection is made based on the type of conviction when compared to the job’s duties. Once that is determined, the severity of the conviction may also be taken into account.
