On July 27, 2016, the Federal Minimum Wage and Employee Polygraph Protection Act (EPPA) workplace postings were updated by the U.S. Department of Labor with an effective date of August 1, 2016. The DOL considers both of these changes mandatory.
· In November 2015, Congress passed the Federal Civil Penalties Inflation Adjustment Act to advance the deterrent effect of civil monetary penalties. The new law directs agencies to adjust their penalties for inflation each year, and requires agencies to publish “catch-up” rules this summer to make up for lost time since the last adjustment. The law requires the amounts to be determined by July 1, 2016 and effective August 1, 2016.
· Because of the changes to the penalty amount, both the federal minimum wage poster and the EPPA poster need to be updated to remove the old penalty amounts. This update to the posting needs to occur by August 1, 2016 when the new rates become effective. Below are links to the updated posters provided by the DOL that can be printed off and posted.
