Mandatory Poster Update

Three newly revised employment law posters are now required to replace previous versions.  The federal Fair Labor Standards Act (FLSA) poster and Employee Polygraph Protection Act (EPPA) poster were updated by the U.S. Department of Labor with an effective date of August 1, 2016.  The Utah state Workers’ Compensation poster was updated by the Utah Labor Commission effective June 22, 2016.  All three of these changes are considered mandatory.

The FLSA poster has been updated with information on new penalty amounts and new language regarding breaks for nursing mothers and misclassification of independent contractors.  Utah’s Workers Compensation poster has been updated with new contact information including a website address.  Here are links to the updated posters that can be printed and posted.

Note that some poster vendors are claiming the new Utah law requiring employers to reasonably accommodate pregnant employees also requires a mandatory poster.  It does not.  The law states that the required notice to employees of their rights can be provided by either a posting or by inclusion in an employee handbook.
