The Occupational Safety and Health Administration (OSHA) has dropped its policy of allowing union representatives into non-union workplace inspections. The change in policy comes after a court challenge by the National Federation of Independent Businesses. The Federation argued that OSHA’s change in policy was so broad that it should be considered a rule change, subject to public review, before taking effect. OSHA has indicated that its policy, contained in a 2013 letter of interpretation, has been rescinded and the guidance will be removed from OSHA’s inspection manual.
