Employers with deadlines to respond to Charges of Discrimination filed with the EEOC received a de facto extension of time when the federal government partially shutdown for the month of January. This meant that the EEOC portal for respondents, through which position statements and other responsive documentation are filed, was down and respondent-employers were unable to upload their statements.
Late last week, the EEOC notified respondents that the portal was operational once more. For responses due between December 22, 2018, and January 29, 2019, the deadline is approaching quickly, as responses are now due February 12, 2019. For employers who received notice of a claim in this timeframe, rather than a deadline to submit a response, the deadline is now March 1, 2019.
