EEOC: Employers Must Collect Pay Data from 2017 and 2018 for EEO-1

The Equal Employment Opportunity Commission (EEOC) announced last week that it had selected 2017 as the second year for which “Component 2” pay data—broken down by race, sex and ethnicity—must be reported by employers subject to EEO-1 report filing requirements. The deadline is September 30, 2019. Filers should continue to use the currently open EEO-1 portal to submit “Component 1” data from 2018 by May 31, 2019.

On April 25, Judge Tanya S. Chutkan of the U.S. District Court for the District of Columbia set the September 30 deadline for turning over 2018 pay data, but stated in her ruling that the EEOC could select either 2017 or 2019 as the second year for which data would be due. The EEOC has now selected 2017 as the second year for data collection.
